Needed Documents


While this list may seem overwhelming at first, few cases involve all of these documents. Also, it should be noted that this list is not exhaustive, and it is likely that your particular case will require production of one or more other documents which are not found in this itemized list.

Some of these documents may be in the possession and/or control of your spouse or your spouse's attorney, in which case I can obtain them from your spouse or your spouse’s attorney, if necessary.

  1. All federal, state, and local tax returns filed by either or both of you for the previous three years. This should include any and all attachments, forms, or other documents which are part of any such filings, including W-2 statements.
  2. All W-2 statements, payroll statements, interest and dividend statements and other records with respect to all income earned by either or both of you for the previous three years if tax returns for those years have not been filed.
  3. All records with respect to all income earned by either or both of you from January 1 of the current year, to date. In particular, this should include a current pay stub with year-to-date amounts on it.
  4. All financial statements prepared by either or both of you for any purpose during the past five years.
  5. All life insurance policies insuring the lives of either or both of the parties or in which either or both of the parties has any interest. This should include contact information for the carrier, the policy number for any such policy, evidence of the amount of the death benefit, evidence of the cash surrender value of the policy (if applicable), and evidence of any loan balances owed against the policy (if any).
  6. Certificates of title or registrations to any and all automobiles, motor vehicles, boats or other personal property registered in the name of either or both of the parties or in which either or both of the parties has any interest.
  7. Purchase documents and/or contract for any of the vehicles listed in item #6, above.
  8. Documents evidencing the present fair market value of any of the vehicles listed in item #6, above. For a motor vehicle, this should include a printout of the Kelly Blue Book value for each vehicle.
  9. Documents evidencing the balance owed for the purchase of, or secured by, any vehicle listed in item #6, above.
  10. All documents relating to all real property owned jointly or separately by the parties or in which either of the parties has any interest whatsoever including, but not limited to, deeds, real estate contracts, appraisals and most recent tax statements.
  11. Statements of current balances for any and all loans owed against or secured by any of the properties referenced in item #10, above.
  12. All stocks, bonds, or other securities or a list of all stocks, bonds, or other securities owned by either or both of the parties or in which either or both of the parties has an interest showing the number of shares and the exchange where said items are held or traded.
  13. Location of all safe deposit boxes to which either or both of the parties has access and evidence of or a list of the contents of any such safe deposit boxes.
  14. Current statements for all checking, savings, business or other bank accounts or money market accounts in which either or both parties has an interest currently. In the event you believe your spouse is concealing income or savings, then this should include passbooks, statements, canceled checks, check registers or certificates of deposit for any account in the name of either or both parties or in which either or both parties has had an interest in the past 24 months, whether or not such account is presently open or closed.
  15. Statements or other documents evidencing all debts of the parties. This should include statements for any and all credit card debts.
  16. Statements for any and all pensions, profit sharing plans or any other gross retirement benefits in which either or both parties has any interest, and any and all documents showing either party’s financial interest therein, including, but not limited to, the most recent annual or quarterly statement showing the dollar amounts of you or your spouse’s contributions, the contributions of the employer and the monthly benefit, if any, to which either party would be entitled if either party terminated as of the present date, and all documents showing the balance in any IRA account of either party.
  17. All records relating to any expenses or sums paid by either or both parties for which either or both parties received reimbursement from the employer or anyone else during the last 24 months.
  18. All records of all trust, estates, life estates or any other property in which either or both parties has any beneficial interest whatsoever including a remainder interest or a contingent remainder interest.
  19. Any and all partnership agreements, employment agreements, buy and sell agreements, stock purchase or option agreements or any other agreements between either or both parties and any firm, corporation or individual.
  20. All appraisals prepared by anyone for any real or personal property in which either or both parties has an interest.
  21. All documents evidencing the interest of either or both parties in all partnerships, corporations, or other businesses in which either or both has a financial interest.
  22. Evidence of each party’s current monthly expenses or a list thereof.
  23. Deeds, contracts, mortgages, promissory notes, title insurance policies and any other written documents or records relating to any real or personal property which either or both parties have sold or disposed of, but from which either or both of you has not collected all of the proceeds of sale and on which there is now due and owing to either or both of you money or other property.
  24. Any negotiable securities including, but not limited to, stocks, bonds, promissory notes and time certificates of deposit which either of you owns or has an interest in or in which either or both of you are named as a payee or alternate or joint payee.
  25. All documents evidencing any aspect of day care and/or its costs, if any, including, but not limited to, day care provider’s name, address, phone, and amount paid per month.
  26. All documents evidencing any health insurance costs incurred by either or both of you. This should include a copy of the insurance card, any applicable insured name, policy and/or group number, billing address and phone number, and plan administrator name, address, and phone number.
  27. All documents evidencing who is covered by the insurance in the item immediately above and the cost for such insurance.
